El presente Aviso Legal regula el acceso y uso del sitio web MUNDO-MASCOTIX.COM (en adelante, el «Sitio Web»), a través del cual se presta, entre otros, el servicio de venta a distancia al público de productos para animales de compañía y de medicamentos veterinarios no sujetos a prescripción veterinaria. La navegación y/o el uso del Sitio Web atribuyen la condición de Usuario e implican la aceptación plena de las disposiciones incluidas en este Aviso Legal, en la versión publicada en el momento en que se acceda al mismo.

3. Objeto del Sitio Web

A través del Sitio Web, MUNDO MASCOTIX ofrece:
• La venta online de medicamentos veterinarios no sujetos a prescripción veterinaria, bajo la supervisión del Farmacéutico Garante indicado en el apartado anterior.
• La venta de productos zoosanitarios, de nutrición, higiene, accesorios y demás artículos para animales de compañía que no tienen la consideración de medicamento.
• Información general de carácter divulgativo sobre el cuidado y la salud de los animales de compañía, de carácter meramente orientativo, que en ningún caso sustituye el diagnóstico, la prescripción o el consejo de un veterinario colegiado.No se comercializan a través del Sitio Web medicamentos veterinarios sujetos a prescripción veterinaria, cuya venta a distancia no está permitida por la normativa vigente.

4. Normativa aplicable a la venta a distancia de medicamentos veterinarios

The distance selling of non-prescription veterinary medicines carried out through the Website is governed, among others, by the following provisions:
• Regulation (EU) 2019/6 of the European Parliament and of the Council of 11 December 2018 on veterinary medicinal products, in particular Article 104 thereof.
• Commission Implementing Regulation (EU) 2021/1904 of 29 October 2021 adopting the design of the common logo for the distance retail sale of veterinary medicinal products.
• Royal Legislative Decree 1/2015, of July 24, which approves the consolidated text of the Law on guarantees and rational use of medicines and health products (art. 3.5).
• Royal Decree 666/2023, of July 18, which regulates the distribution, prescription, dispensing and use of veterinary medicines (especially chapter V).
• Law 34/2002, of July 11, on Information Society Services and Electronic Commerce (LSSI-CE).
• Royal Legislative Decree 1/2007, of November 16, which approves the consolidated text of the General Law for the Defense of Consumers and Users, in relation to distance contracting.
• Regulation (EU) No 524/2013 of the European Parliament and of the Council of 21 May 2013 on online dispute resolution for consumer disputes.

5. Información exigida por el artículo 104.5 del Reglamento (UE) 2019/6

c) Common logo for distance selling of veterinary medicines
In compliance with Article 104.5.c) of Regulation (EU) 2019/6 and Implementing Regulation (EU) 2021/1904, the common logo of the European Union for the distance selling of veterinary medicines (graphic design with the Spanish flag and the letters "vet") will be clearly visible on all pages of the Website related to the offer of distance selling of veterinary medicines, linked permanently and reciprocally to the list of authorized retailers of the Community of Madrid, available through the MAPA page indicated in the previous section.

6. Condiciones específicas de la venta a distancia de medicamentos veterinarios

• Únicamente se ofrecen a la venta a distancia medicamentos veterinarios no sujetos a prescripción veterinaria. Queda excluida la venta a distancia de medicamentos sujetos a prescripción.
• La dispensación se realiza con la supervisión directa del Farmacéutico Garante identificado en el apartado 2, quien supervisa el proceso y atiende las consultas farmacéuticas que puedan plantear los Usuarios a través de los datos de contacto facilitados en el apartado 1.
• El Usuario se compromete a hacer un uso adecuado y responsable de los medicamentos adquiridos, siguiendo estrictamente las indicaciones del prospecto, del etiquetado y, en su caso, las recomendaciones del Farmacéutico Garante o de un veterinario colegiado.
• No se realizarán recomendaciones farmacológicas personalizadas a través del Sitio Web sin la adecuada valoración previa por parte de un profesional cualificado.
• Queda prohibida la reventa o comercialización posterior de los medicamentos veterinarios adquiridos a través del Sitio Web.
• MUNDO MASCOTIX cumple con los requisitos de conservación, trazabilidad y envío de los medicamentos veterinarios establecidos en el Real Decreto 666/2023 y demás normativa aplicable.

7. Environmental management of packaging

In compliance with Royal Decree 1055/2022, of December 27, on packaging and packaging waste, and Law 7/2022, of April 8, on waste and contaminated soils for a circular economy, Mundo Mascotix informs of the following in relation to the packaging it places on the market through its distance selling activity:Mundo Mascotix is registered in the Register of Product Producers as a producer of commercial and industrial packaging, with registration number ENV/2026/000107709 , and adheres to the Collective Extended Producer Responsibility System (SCRAP) managed by Gestión de Envases Comerciales e Industriales, SL (GENCI) , thus guaranteeing the correct management, recycling and valorization of the corresponding packaging.As part of this commitment, Mundo Mascotix prioritizes the reuse of packaging materials (boxes, bubble wrap, air bags, and similar items) from its own distributors whenever shipping conditions allow, resorting to new packaging only when reuse is not possible. 8. Applicable law and jurisdiction

In general, the relationship between Mundo Mascotix and the Users of its online services provided through the Website is governed by Spanish law and subject to the jurisdiction of the Spanish courts. When the User is a consumer, the courts of the User's domicile will have jurisdiction, in accordance with consumer protection regulations. In all other cases, the parties expressly submit to the jurisdiction of the courts of Madrid, waiving any other jurisdiction that may apply, to resolve any dispute that may arise in the interpretation or execution of these terms and conditions.

The User is informed, and accepts, that access to the Website does not imply, in any way, the beginning of a commercial relationship with Mundo Mascotix .
